Federal airspace laws take precedence over state drone laws. If a state or local law directly conflicts with FAA regulations, the state or local law is likely to be invalidated. All commercial drone pilots operating in Hawaii must adhere to the FAA's Part 107 Rules.
While the Hawaii State Legislature has not passed comprehensive, statewide operational laws for drone pilots, several state government agencies have established binding administrative rules that all operators must follow.
No state drone laws. However, a statue did establish an unmanned aerial systems test site advisory board.
State Agency Administrative Rules
Department of Transportation (DOT) - Airports: Hawaii Administrative Rules prohibit the operation of any unmanned aircraft at a state airport, including Daniel K. Inouye International Airport, without prior permission from the airport manager.
Department of Land and Natural Resources (DLNR) - State Parks & Lands: It is prohibited to launch, land, or operate a drone within any lands managed by the DLNR, which includes Hawaii’s State Parks, Natural Area Reserves, and Forest Reserves, except with a specific permit issued by the department.
State Governance and Development (HRS § 201-72.6) This state statute established the Hawaii unmanned aerial systems test site advisory board. This board, a subcommittee of the Hawaii aerospace advisory committee, is tasked with overseeing the planning and operation of the state's UAS test site, signaling the state's interest in fostering the drone industry.
In addition to state agency rules, individual counties may have their own drone ordinances, particularly concerning public spaces. For example, some counties restrict or prohibit the use of drones within county parks. It is essential to research and comply with all local rules in your specific area of operation.
